By accessing or using the API available at api.twincher.ai (the “API”) provided by Arkady Gonoskov (“Provider”), you (“User”) agree to the following Terms of Use (“Terms”). If you do not agree to these Terms, you must not use the API.

1. Limited License for Evaluation Use

1.1. Provider grants User a non-exclusive, non-transferable, revocable, limited license to access and use the API solely for internal evaluation, testing, and demonstration purposes.

THE API IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

PROVIDER SPECIFICALLY DISCLAIMS ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, PERFORMANCE, RELIABILITY, AND ACCURACY.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

(a) PROVIDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS;

(b) PROVIDER'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE API SHALL NOT EXCEED ZERO (0) OR ANY MINIMUM REQUIRED BY LAW.

User acknowledges that the API may be experimental, incomplete, or unstable and that Provider assumes no responsibility for any errors, failures, or losses resulting from its use.

7. Data and Privacy

7.1. Provider may process technical and usage data submitted via the API for purposes of operation, debugging, rate limiting, analytics, and improving the service.

7.2. The API is not intended to process sensitive, confidential, or legally protected information. User agrees not to submit such data.

8. Suspension or Termination

Provider may limit, suspend, or terminate User’s access to the API at any time, with or without cause, without liability.

9. No Obligation to Continue Service

Provider is not obligated to maintain, support, update, or continue providing the API. The API may be altered or discontinued at any time.

10. Governing Law

These Terms are intended to be globally applicable without reference to any specific jurisdiction. In the event that a governing law is required for enforcement or interpretation, the governing law shall be the law of a jurisdiction selected by Provider at its discretion, unless otherwise required by mandatory applicable law.

11. Entire Agreement

These Terms constitute the entire agreement between Provider and User regarding the API and supersede all prior or contemporaneous communications or agreements. Provider may update these Terms at any time by posting a revised version. Continued use of the API constitutes acceptance of the revised Terms.
